The Raffle is governed by the Ohio law and open only to purchasers present in Ohio at the time of entry purchase who are at least 18 years old at time of entry purchase. United States citizenship is not required to purchase an entry or to win. The following individuals and their respective affiliates, subsidiaries, parent and related companies and agencies are not eligible to win a prize in the Raffle. Executive management and officers of Cohesion Foundation Inc. and their immediate family members residing in the same household.
ALL PURCHASES MUST BE MADE BY ELIGIBLE ENTRANTS LOCATED WITHIN THE STATE OF OHIO AT THE TIME OF PURCHASE. The Cohesion Foundation shall be the sole judge of the validity and eligibility of all entries. All Raffle Ticket purchases shall be final, and no refunds or replacements will be issued by Cohesion Foundation unless the Raffle is canceled by Cohesion Foundation. Entries which are or appear to be tampered with are void. Only one (1) individual may be identified as an entry purchaser. The Raffle is conducted in English. Entries may be purchased via the internet or in person at certain Ohio State sporting events. Entry purchasers providing the Raffle with a valid email address will receive confirmation number(s) by return email. For all other entry purchasers, ticket confirmation number(s) will be physically handed to the purchaser at the time of purchase. This is the only confirmation that will be provided. If purchase was made online, the ticket copy is not required to claim a prize. If the purchase was made in person, the physical copy of the ticket is required to claim. All entries are non-refundable.
In the Raffles, there is no possibility of a tie. All draws will be under the supervision of the Administrator. Entry purchasers may win more than one prize if Cohesion Foundation offers other prizes other than the main 50/50 Jackpot. All listed prizes will be available online. All time references are to Eastern Time Zone. All entries are nonrefundable unless the Raffle is cancelled by Cohesion Foundation.
Main Raffle Drawings: An unlimited number of tickets will be sold. 5 tickets for $10, 20 tickets for $20, 85 tickets for $40 or 400 tickets for $100. Draw dates are outlined on the raffle website.
Cohesion Foundation will make reasonable efforts to contact prize winner using information provided on the entry form if purchase is made online. For in-person ticket purchases, the winner is responsible for presenting themselves to the Cohesion Foundation. If a prize winner does not contact Cohesion Foundation within 30 days after the winning number is announced, the Cohesion Foundation shall retain the winning share of the prize.
Cohesion Foundation will not award a prize if the prize winner (a) was ineligible to purchase a ticket or otherwise enter the Raffle, (b) provided materially false or misleading information to Cohesion Foundation in connection with the purchase of a Raffle ticket, or (c) if participating in this Raffle or receiving a prize is prohibited with respect to such person pursuant to these Rules or Applicable Law. No other Raffle ticket will be substituted for a Raffle ticket, and Cohesion Foundation will retain the prize. A Ticket Holder cannot assign or transfer his/her interest in a Raffle ticket or a prize won by a winning Raffle ticket.
By entering the Raffle, entry purchasers agree that their information provided in connection with the Raffle entry may be used for communications promoting the Raffle and future raffles sponsored by or conducted for the benefit of Cohesion Foundation. An entry purchaser may subsequently “opt-out” of the receipt of such communications by following the directions in any email, other communication or by contacting the Administrator (contact information below). Purchase of an entry in the Raffle constitutes permission for the Raffle and Cohesion Foundation to use winner’s name, address and/or likeness, in perpetuity, for purposes of advertising the Raffle or future raffles without further consent or compensation, unless prohibited by law.
Potential winners must complete all steps outlined in their winners’ letter within the designated timeframe. If an entrant is found to be ineligible, or if a potential winner does not comply with the Official Rules, then the potential winner will be disqualified and the prize or a cash equivalent will revert to Cohesion Foundation.
Except as described in the previous paragraph, entry purchasers, by participating in the Raffle (and winners, by accepting a Raffle prize), release Cohesion Foundation, partners, subsidiaries, agents, representatives, sponsors, service agencies and independent contractors, and each of their respective directors, officers, partners, employees and agents, including advertising and promotion agencies, from any and all liability with respect to participation in the promotion, possession, use and distribution of the prize(s) awarded.
The Raffle will pursue all available legal remedies against any individual(s) damaging or attempting to damage any Cohesion Foundation Rafflebox website or attempting to undermine the lawful operation of the Raffle.
Cohesion Foundation has been approved for tax-exempt status under Code Section 501(c)(3) and for classification as a public charity under Code Sections 509(a)(1) and 170(b)(1)(A)(vi).
Should a dispute arise between a purchaser and Cohesion Foundation, purchaser agrees that all cases, controversies, and legal issues shall be governed by the laws and jurisdiction of the State of Ohio.
All winners shall be responsible for any and all federal, state and local income or excise taxes, fees, assessments and like charges associated with the prizes. All cash prizes will be paid net of applicable income tax withholding.
At the time of this printing, federal law requires that corresponding tax withholding on prize values of $5,000 or greater must be collected from winners upon award and distribution. Federal and state withholding laws are subject to change without notice. The withholding laws in effect at the time prizes are claimed will be followed. The IRS has taken the position that amounts paid for chances to participate in raffles, lotteries or similar programs are not gifts and, therefore, the price of the entry does not qualify as a deductible charitable contribution.
